PRELIMINARY ARTICLE – IDENTIFICATION OF THE OPERATOR
These General Terms and Conditions of Sale (hereinafter “GTC”) are offered by the operator of the chillerhub.com website (hereinafter the “Site”). The operator is:

ARTICLE 1 — GENERAL PROVISIONS
The General Terms and Conditions of Sale (the General Terms and Conditions of Sale , or the GTC ) apply exclusively to online sales of products offered by the Operator on the website https://chillerhub.com/.
The GTC are made available to customers on the Site, where they can be consulted directly, and may also be sent to them on simple request by any means.
The GTC are binding on the customer, who acknowledges, by ticking a box or clicking the button provided for this purpose, that they have read and accepted them before placing an order. Validation of the order by confirmation constitutes the buyer’s acceptance of the GTC in force on the date of the order, the storage and reproduction of which are ensured by the Operator.
ARTICLE 2 — PRODUCT DESCRIPTION
The Site is an online sales site for professional cold-chain equipment (ice machines, blast chillers, freezers, refrigerators, etc.) (hereinafter the Product(s) ).
The Products presented on the Site are each described with their essential characteristics. The photographs illustrating the Products do not constitute a contractual document. The Product instructions for use, where essential, appear on the Site or are sent at the latest upon delivery.
The Products comply with the requirements of French and European law in force at the time they are placed on the market.
ARTICLE 3 — ORDERS
The customer selects the Products they wish to order on the Site. The customer may check the details of the order and its total price, correct any errors, and confirm the order to express acceptance.
The Operator reserves the right to refuse any order for legitimate reasons, in particular in the event of abnormal quantities ordered, a dispute relating to payment of a previous order, or suspected fraud.
After validation of the order, the customer receives an order confirmation by email. The sale is final only after receipt by the customer of this confirmation email and full collection of the price by the Operator.
ARTICLE 4 — PRICES AND PAYMENT TERMS
The prices of the Products are indicated on the Site in euros, all taxes included, excluding delivery costs unless otherwise stated. Delivery costs are specified before final validation of the order.
The Operator reserves the right to change prices at any time. Products are invoiced on the basis of the prices displayed at the time the order is validated, subject to availability.
Payment is due immediately when the order is placed. The customer guarantees that they are fully authorised to use the payment method chosen for payment of the order.
ARTICLE 5 — DELIVERY
The terms, costs and estimated delivery times are specified during the order process and in the Shipping Policy available on the Site.
The Operator undertakes to deliver the Products within the period indicated to the customer and, in any event, no later than thirty (30) days after receipt of the order, unless otherwise agreed by the parties.
Risk is transferred to the customer when the customer, or a third party designated by the customer other than the carrier proposed by the Operator, takes physical possession of the Product.
ARTICLE 6 — RIGHT OF WITHDRAWAL AND RETURNS
In accordance with the applicable provisions of the French Consumer Code, the consumer customer has a period of fourteen (14) days from receipt of the Product to exercise their right of withdrawal without having to give any reason.
The procedures for exercising this right, the return conditions, exceptions and refund arrangements are described in the Refund Policy available on the Site.
ARTICLE 7 — LEGAL GUARANTEES
The customer benefits from the legal guarantee of conformity and the guarantee against hidden defects, in accordance with the provisions of the French Consumer Code and the French Civil Code.
Under the legal guarantee of conformity, the consumer may request repair or replacement of the Product, subject to the cost conditions provided by law, and may in certain cases obtain a price reduction or cancellation of the sale.
ARTICLE 8 — LIABILITY
The Operator cannot be held liable for non-performance or improper performance of the contract attributable to the customer, to the unforeseeable and unavoidable act of a third party to the contract, or to force majeure.
The customer is responsible for choosing Products suited to their needs and for complying with the installation, use and maintenance instructions provided.
ARTICLE 9 — PERSONAL DATA
The Operator processes customers’ personal data in accordance with the Privacy Policy available on the Site and with Regulation (EU) 2016/679 of 27 April 2016 (GDPR).
ARTICLE 10 — INTELLECTUAL PROPERTY
All elements of the Site, including texts, photographs, graphics, logos, icons, sounds, software and more generally all elements reproduced or used on the Site, are protected by intellectual property law.
Any reproduction, representation, adaptation or use, in whole or in part, without prior written authorisation from the Operator is prohibited.
ARTICLE 11 — APPLICABLE LAW AND DISPUTES
These GTC are governed by French law, without prejudice to any mandatory protective provisions applicable in the consumer’s country of residence.
In the event of a complaint, the customer is invited to contact customer service first at contact@comptoir-du-froid.fr. If no amicable solution is found, the customer may use any competent mediation or dispute-resolution procedure.
